Effective Arbitration
May 20 - 22, 2009




 

Role and Techniques of Effective Arbitration, taught by Merlyn Clark, is an exciting course for 2009.  

 

Arbitration today is most commonly used for the resolution of commercial disputes, and sometimes used to enforce credit obligations. It is also used to resolve other types of disputes, such as labor disputes, consumer disputes or family disputes, and for the resolution of certain disputes between states and between investors and states.

 

What you will learn:

 

·        What arbitration is about and what is arbitrable

·        What laws and rules govern the arbitration process

·        How to convene an arbitration and maintain control of the process

·        How to conduct pre-hearing procedures, issue orders and resolve pre-hearing matters, including discovery and dispositive motions

·        How to conduct and preside at an arbitration hearing

·        How to write an award and avoid reviewable conduct

·        Ethics for arbitrators and counsel in arbitration proceedings

·        Advocates will learn how to effectively represent clients in the arbitration process

·

·        Practitioners and Judges planning to enter the arbitration practice

·        Litigators wanting to better utilize arbitration and gain insights into the process
